Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Photora ("Photora", "we", "us"), the operator of the website photora.fun and the AI photo transformation service available through it (together, the "Service"). By creating an account, purchasing credits or a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement.

2. The Service

Photora uses third-party artificial-intelligence image models to transform photographs you upload ("Input Images") into stylized professional headshots ("Output Images"). Free accounts receive a limited number of trial generations that produce watermarked, reduced-resolution previews. Paid customers receive full-resolution Output Images without a watermark, subject to the credit or quota limits of their plan.

AI-generated content is probabilistic. We do not guarantee that any Output Image will meet your expectations, be free of visual artifacts, or be suitable for any particular purpose. Results depend heavily on the quality of the Input Image.

3. Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@photora.fun if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, are used fraudulently, or abuse the Service (including attempts to circumvent rate limits, watermarks, or payment requirements).

4. Acceptable Use

You agree that you will only upload photographs of yourself, or of people who have given you their explicit consent to have their likeness processed by an AI service. You must not upload or attempt to generate:

  • images of any person without their consent, including public figures;
  • images of minors;
  • sexually explicit, violent, hateful, or otherwise unlawful content;
  • content intended to impersonate, defraud, defame, or harass any person, or to create misleading "deepfake" material;
  • content that infringes any third party's copyright, trademark, privacy, or publicity rights.

You must not reverse-engineer the Service, scrape it, resell access to it, use automated tools to create accounts or generate images, or attempt to remove watermarks from preview images. We may refuse to process any content and may remove content and terminate accounts at our discretion for violations of this section.

5. Your Content and License

You retain all rights you hold in your Input Images. You grant Photora a limited, non-exclusive, worldwide license to store, reproduce, and process Input Images solely to operate the Service — including transmitting them to our AI model providers for processing. We do not use your images to train AI models and we do not sell them.

Subject to your compliance with these Terms and payment of applicable fees, Photora assigns to you all rights it may hold in your Output Images. You may use them for any lawful personal or commercial purpose. Note that the copyright status of AI-generated images varies by jurisdiction and we make no warranty regarding registrability.

6. Credits, Subscriptions, and Payments

Payments are processed by Paddle, acting as merchant of record. Paddle handles checkout, taxes, and payment security; your purchase is also subject to Paddle's terms. Prices are shown at checkout and may change prospectively at any time.

  • Credit packs are one-time purchases. Credits do not expire but are non-transferable and have no cash value.
  • Subscriptions renew automatically each billing period until canceled. You can cancel anytime and retain access until the end of the paid period. Monthly generation quotas reset each billing month and unused quota does not roll over.
  • One generation (preview or HD) consumes one credit or one unit of quota, including generations you consider unsatisfactory, except where our Refund Policy provides otherwise (e.g., technical failures on our side are not charged).

7. Refunds

Refunds are governed by our Refund Policy. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer in your country of residence.

8. Third-Party Services

The Service depends on third-party providers, including AI model providers (accessed via OpenRouter), Google (optional sign-in), and Paddle (payments). We are not responsible for outages or changes in those services, but we will make reasonable efforts to maintain continuity of the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT IMAGES WILL BE ACCURATE, FLATTERING, OR FIT FOR ANY PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTORA'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold Photora harmless from claims, damages, and expenses (including reasonable legal fees) arising from your Input Images, your use of Output Images, or your breach of these Terms — including any claim that you processed another person's likeness without consent.

12. Termination

You may stop using the Service and delete your account at any time by contacting support@photora.fun. We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, or where required by law. Upon termination, unused free credits lapse; paid entitlements are handled per the Refund Policy and applicable consumer law.

13. Changes to the Service or Terms

We may modify the Service or these Terms. For material changes we will give notice (e.g., by email or an in-app notice) at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and, where a change materially disadvantages an active paid plan, you may request a pro-rata refund of the unused portion.

14. Governing Law and Disputes

These Terms are governed by the laws applicable at Photora's place of establishment, without regard to conflict-of-law rules, except where mandatory consumer-protection law of your country of residence applies. Before bringing a formal claim, you agree to contact us at support@photora.fun so we can attempt to resolve the dispute informally within 30 days.
